Booking / Contract Terms and conditions:
ENTIRE AGREEMENT: This contract contains the entire understanding between ELOPE BRISBANE and the CLIENT. It supersedes all prior and simultaneous agreements between the parties.
The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived.
The party against whom a waiver is sought to be effective must have signed a waiver in writing.
DATE RESERVATION:
A signed booking form and 20% non-refundable reservation fee, payable via direct deposit are required to reserve the specified vendors, styling items and more importantly the calendar date of the wedding as set by the CLIENT in this contract. Wedding bookings by nature are uniquely conditional to a specific date request by THE CLIENT and therefore attract a reservation fee to hold said date upon THE CLIENT’S request. THE CLIENT understands that upon reserving their wedding date, the primary purpose of the reservation fee is to exclude other potential clients from the same date should their wedding booking requirements overlap.
The CLIENT understands the climate (e.g. economic climate or personal circumstances) in which they are reserving their wedding date.
Final payment of balance is due via direct deposit 2 weeks before the wedding date.
Any changes the clients choose to make to this agreement, such as additional guest numbers, adding optional extras etc. must be discussed with Romana in writing and final changes submitted via an amended booking form and resend to ELOPE BRISBANE.
All changes must occur before at least 1 week before the wedding date.
If delay or hold ups occur (outside our control) Elope Brisbane reserve the right to charge an additional fee. Should the ceremony start more than 30 minutes from the scheduled ceremony time. Elope Brisbane cannot be held accountable due to delays outside their control.
All styling items included in this agreement are included on a hire basis only, and therefore must remain on site. Should any items be removed or damaged the client agrees to compensate Elope Brisbane for any losses. Amount / charges to be determined based on said loss and replacement options.
CANCELLATIONS:
THE CLIENT understands that unlike many other industries, replacement bookings for specific dates are improbable.
Therefore, in the event of cancellation by THE CLIENT, the reservation fee or amounts paid to date are non-refundable. It shall be liquidated damages to ELOPE BRISBANE in the event of a breach of contract by CLIENT. As previously mentioned, the reservation fee prohibits Elope Brisbane from booking overlapping clients. So, the cancellation of booking by THE CLIENT will result in a loss of income for Elope Brisbane for the booked date.
In addition, The CLIENT shall also be responsible for payment for any materials charges incurred up to the time of cancellation that are not included in the initial 30% package reservation fee. E.g. if THE CLIENT has booked additional fresh florals for their ceremony set-up and cancels, the client may be charged the cost of fresh flowers should the florist not return paid monies.
POSTPONEMENTS:
In the event the CLIENT request to postpone services, a request to postpone must be in writing and occur at least 1 month before booked date. A postponement can be rescheduled within one calendar year of original date and subject to availability. One postponed date will be accepted. Additional fees may be applied should the package price increase in that time.
ELOPE BRISBANE reserves the right to charge additional fees, should the rescheduled date incur additional cost, ELOPE BRISBANE will work cooperatively towards a new date suitable to all parties involved.
COVID (and the like):
Should an unlikely event arise, (that is the fault of neither the CLIENT nor ELOPE BRISBANE), ELOPE BRISBANE will happily transfer the booking to another similar date (within one calendar year of the original date) free of charges and fees. Other options, at the discretion of ELOPE BRISBANE, may also be offered, such as a credit note for other services. An example of such an event, is a government directive directly impacting the wedding, for instance, Qld lockdowns that prevent the wedding from being performed. Note: Border closures do not prevent a wedding from going ahead unless the couple are unable to enter Qld.
The client hereby grants to ELOPE BRISBANE and associates, the irrevocable and unrestricted right to use and publish photographs of this wedding set up. Imagery of the ceremony set up may be used for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases Elope Brisbane and its associates and assigns from all claims and liability relating to said photographs.
Payment of any monies is also considered an agreement to all terms and conditions.
